Welcome to the series of books on intellectual property law launched at the Law School of the University of Geneva in 2008 in which the proceedings of the conferences on intellectual property law (www.jdpi.ch) which are held each year at the Law School of the University of Geneva are published.


Volume 1: Sport and Intellectual Property
The first volume of the series comprises the papers which were written for the conference of intellectual property law of February 2, 2009 which was devoted to the theme Sport and Intellectual Property / Sport et propriété intellectuelle.


Volume 2: Resolution of intellectual property disputes
The second volume comprises the papers which were written for the conference of intellectual property law of February 8, 2010 which was devoted to the theme Resolution of intellectual property disputes/La résolution des litiges de propriété intellectuelle


Volume 3 : Well-known and Famous Trademarks
The third volume comprises the papers which were written for the conference of intellectual property law of February 15, 2011 which was devoted to the theme Well Known and Famous Trademarks/Marques notoires et de haute renommée.


Volume 4: Intellectual Property in the Pharmaceutical Industry
The fourth volume comprises the papers which were written for the conference of intellectual property law of February 10, 2012 which was devoted to the theme Intellectual Property in the Pharmaceutical Industry/La propriété intellectuelle dans l’industrie pharmaceutique.


Volume 5: Dommages-intérêts suite à la violation de droit de propriété intellectuelle
Etude de la méthode des redevances en droit suisse et comparé
Parmi les actions réparatrices suite à la violation de droit de propriété intellectuelle, la méthode des redevances vise à indemniser le titulaire sur la base des redevances de licence qui auraient été dues dans le cadre d’un contrat de licence.
Elle est régulièrement appliquée à l’étranger mais plus difficilement en Suisse car elle fait l’objet d’une approche stricte du droit commun.
La première partie du travail analyse cette méthode à la lumière de l’ensemble des actions réparatrices en droit international et comparé.
La deuxième partie du travail étudie la méthode en droit suisse, en procédant à une analyse des actions réparatrices, du fondement légal de la méthode, puis de la question controversée des redevances augmentées et enfin de celle du calcul.
